นโยบายความเป็นส่วนตัวสำหรับ การสรรหาบุคลากรผ่านระบบ Teamtailor
บริการสำหรับการดำเนินการสรรหาบุคลากรและอำนวยความสะดวกในกระบวนการจ้างงาน (“บริการ”) ดำเนินการผ่านระบบ Teamtailor ในนามของ บริษัท บีวายดี ออโต้ (ประเทศไทย) จำกัด และ บริษัท บีวายดี ออโต้ คอมโพเนนท์ส (ประเทศไทย) จำกัด (เรียกรวมว่า “ผู้ควบคุมข้อมูลส่วนบุคคล” “บริษัท” “เรา” หรือ “ของเรา”)
บริษัทให้ความสำคัญอย่างยิ่งต่อการทำให้บุคคลที่ใช้บริการ (“ผู้ใช้งาน”) มีความมั่นใจและได้รับข้อมูลที่เพียงพอเกี่ยวกับวิธีการที่บริษัทจัดการข้อมูลส่วนบุคคลของผู้ใช้งานในกระบวนการสรรหาบุคลากร บริษัทมุ่งมั่นที่จะรักษามาตรฐานตามกฎหมายของประเทศไทยเกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคล โดยบริษัทจะดำเนินการประมวลผล จัดการ ใช้งาน และคุ้มครองข้อมูลส่วนบุคคลของผู้ใช้งานตามที่กำหนดไว้ในประกาศความเป็นส่วนตัวฉบับนี้ (“ประกาศความเป็นส่วนตัว”)
1. ข้อมูลทั่วไป
บริษัทเป็นผู้ควบคุมข้อมูลส่วนบุคคลตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลที่มีผลใช้บังคับในประเทศไทย
ข้อมูลส่วนบุคคลของผู้ใช้งานจะได้รับการประมวลผลเพื่อวัตถุประสงค์ในการบริหารจัดการและอำนวยความสะดวกในกระบวนการสรรหาและคัดเลือกบุคลากรเพื่อเข้าทำงานกับบริษัท
บริษัทมีความจำเป็นต้องใช้ข้อมูลส่วนบุคคลของผู้ใช้งานเพื่อวัตถุประสงค์ในการเข้าทำสัญญาจ้างงาน หากผู้ใช้งานไม่ให้ข้อมูลส่วนบุคคลดังกล่าว อาจส่งผลให้บริษัทไม่สามารถเข้าทำสัญญาจ้างงานกับผู้ใช้งานได้
2. การเก็บรวบรวมข้อมูลส่วนบุคคล
บริษัทเป็นผู้รับผิดชอบในการประมวลผลข้อมูลส่วนบุคคลที่ผู้ใช้งานได้ให้ไว้ผ่านบริการ หรือข้อมูลส่วนบุคคลที่บริษัทเก็บรวบรวมด้วยวิธีการอื่นที่เกี่ยวข้องกับบริการดังกล่าว
การเก็บรวบรวมข้อมูลส่วนบุคคลเมื่อใดและอย่างไร
บริษัทเก็บรวบรวมข้อมูลส่วนบุคคลของผู้ใช้งานจากผู้ใช้งานเมื่อผู้ใช้งาน
• สมัครงานผ่านบริการหรือช่องทางอื่น โดยเพิ่มข้อมูลส่วนบุคคลของตนเอง ไม่ว่าจะเป็นการกรอกข้อมูลด้วยตนเองหรือโดยการใช้แหล่งข้อมูลจากบุคคลภายนอก เช่น Facebook หรือ LinkedIn และ
• ใช้บริการเพื่อเชื่อมต่อกับพนักงานของบริษัท โดยเพิ่มข้อมูลส่วนบุคคลของตนเอง ไม่ว่าจะเป็นการกรอกข้อมูลด้วยตนเองหรือโดยการใช้แหล่งข้อมูลจากบุคคลภายนอก เช่น Facebook หรือ LinkedIn และ
• ให้ข้อมูลที่สามารถระบุตัวตนได้ผ่านระบบแชท (ที่ให้บริการผ่านเว็บไซต์ที่ใช้บริการดังกล่าว) และข้อมูลดังกล่าวมีความเกี่ยวข้องกับกระบวนการสมัครงาน
•บริษัทอาจเก็บรวบรวมข้อมูลจากบุคคลภายนอก เช่น Facebook, LinkedIn และแหล่งข้อมูลสาธารณะอื่น ๆ โดยกระบวนการดังกล่าวเรียกว่า “Sourcing” ซึ่งอาจดำเนินการโดยพนักงานของบริษัทหรือดำเนินการโดยอัตโนมัติผ่านบริการ
•ในบางกรณี พนักงานปัจจุบันของบริษัทอาจแนะนำผู้สมัครที่มีศักยภาพให้แก่บริษัท โดยพนักงานดังกล่าวอาจเพิ่มข้อมูลส่วนบุคคลของผู้สมัครที่ได้รับการแนะนำ ในกรณีดังกล่าว บุคคลที่ได้รับการแนะนำจะถือเป็น “ผู้ใช้งาน” ภายใต้ประกาศความเป็นส่วนตัวฉบับนี้ และจะได้รับแจ้งเกี่ยวกับการประมวลผลข้อมูลส่วนบุคคลดังกล่าว
ประเภทของข้อมูลส่วนบุคคลที่เก็บรวบรวมและประมวลผล
บริษัทจะเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคล รวมถึงแต่ไม่จำกัดเพียงข้อมูลดังต่อไปนี้

- ชื่อ
- นามสกุล
- คำนำหน้าชื่อ (ภาษาอังกฤษ)
- ชื่อภาษาอังกฤษ

- เพศ
- อีเมลส่วนบุคคล
- รหัสพื้นที่หมายเลขโทรศัพท์
- หมายเลขโทรศัพท์มือถือ
- สถานศึกษา
- ระดับการศึกษา
- สาขาวิชา
- ประสบการณ์การทำงานในอุตสาหกรรม
- จำนวนครั้งที่เปลี่ยนงาน
- เหตุผลในการลาออก
- เงินเดือนปัจจุบัน (ก่อนหักภาษี)
- เงินเดือนที่คาดหวัง (ก่อนหักภาษี)

ในกรณีที่บริษัทมีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลที่มีความอ่อนไหว เช่น ข้อมูลสุขภาพ หรือข้อมูลประวัติอาชญากรรม บริษัทจะขอความยินยอมโดยชัดแจ้งจากผู้ใช้งาน และจะดำเนินการภายใต้การกำกับดูแลของหน่วยงานที่มีอำนาจตามกฎหมายของประเทศไทย
วัตถุประสงค์และฐานทางกฎหมายในการประมวลผลข้อมูล
วัตถุประสงค์ของการเก็บรวบรวมและประมวลผลข้อมูลส่วนบุคคลคือเพื่อการบริหารจัดการกระบวนการสรรหาบุคลากร
ฐานทางกฎหมายในการประมวลผลข้อมูลส่วนบุคคลอาศัยความยินยอมที่บริษัทได้รับจากผู้ใช้งาน
ในกรณีที่ไม่ได้รับความยินยอม บริษัทอาจใช้ฐานทางกฎหมายอื่นที่กฎหมายอนุญาตให้ใช้ในการประมวลผลข้อมูลส่วนบุคคลของผู้ใช้งานโดยไม่ต้องได้รับความยินยอม เช่น เพื่อประโยชน์โดยชอบด้วยกฎหมายของบริษัท หรือเพื่อความจำเป็นในการดำเนินการตามคำขอของผู้ใช้งานก่อนการเข้าทำสัญญาจ้างงาน ทั้งนี้ เพื่ออำนวยความสะดวกในการประมวลผลข้อมูลส่วนบุคคล
ความยินยอมของเจ้าของข้อมูลส่วนบุคคล
ผู้ใช้งานยินยอมให้ผู้ควบคุมข้อมูลส่วนบุคคลประมวลผลข้อมูลส่วนบุคคลของตนเพื่อวัตถุประสงค์ในการดำเนินการสรรหาบุคลากร
ผู้ใช้งานยินยอมให้มีการเก็บรวบรวมข้อมูลส่วนบุคคลผ่านบริการ เมื่อผู้ใช้งาน
ก) สมัครงานผ่านบริการ โดยให้ข้อมูลส่วนบุคคลของตนเอง ไม่ว่าจะด้วยตนเองหรือผ่านแหล่งข้อมูลของบุคคลภายนอก เช่น Facebook หรือ LinkedIn และยินยอมให้ผู้ควบคุมข้อมูลส่วนบุคคลใช้เครื่องมือสรรหาจากภายนอกเพื่อเพิ่มข้อมูลเพิ่มเติม
ข) ใช้บริการเพื่อเชื่อมต่อกับฝ่ายสรรหาบุคลากรของผู้ควบคุมข้อมูลส่วนบุคคล โดยให้ข้อมูลส่วนบุคคลของตนเอง ไม่ว่าจะด้วยตนเองหรือผ่านแหล่งข้อมูลของบุคคลภายนอก เช่น Facebook หรือ LinkedIn
ค) ในกรณีที่บริษัทมีความจำเป็นต้องประมวลผลข้อมูลส่วนบุคคลที่มีความอ่อนไหว เช่น ข้อมูลสุขภาพ หรือข้อมูลประวัติอาชญากรรม บริษัทจะขอความยินยอมโดยชัดแจ้งจากผู้ใช้งาน และจะดำเนินการภายใต้การกำกับดูแลของหน่วยงานที่มีอำนาจตามกฎหมายของประเทศไทย
ผู้ใช้งานยินยอมให้ผู้ควบคุมข้อมูลส่วนบุคคลเปิดเผยข้อมูลส่วนบุคคลของตนไปยังบุคคลภายนอกและ/หรือส่งข้อมูลข้ามพรมแดนไปยังต่างประเทศเพื่อวัตถุประสงค์ในการดำเนินการสรรหาบุคลากร
ผู้ใช้งานยินยอมให้ผู้ควบคุมข้อมูลส่วนบุคคลเก็บรวบรวมและประมวลผลข้อมูลที่ผู้ใช้งานเปิดเผยต่อสาธารณะเพื่อวัตถุประสงค์ในการดำเนินการสรรหาบุคลากร
ผู้ใช้งานมีสิทธิถอนความยินยอมของตนเมื่อใดก็ได้ ผ่านการติดต่อผู้ควบคุมข้อมูลส่วนบุคคลตามรายละเอียดการติดต่อในข้อ 9. เว้นแต่จะมีข้อจำกัดสิทธิในการถอนความยินยอมโดยกฎหมายหรือโดยสัญญาที่ให้ประโยชน์แก่เจ้าของข้อมูลส่วนบุคคล อย่างไรก็ตาม การใช้สิทธิดังกล่าวอาจหมายความว่าผู้ใช้งานจะไม่สามารถสมัครงานในตำแหน่งที่ต้องการ หรือไม่สามารถใช้บริการดังกล่าวได้ ทั้งนี้ การถอนความยินยอมจะไม่ส่งผลกระทบต่อการเก็บรวบรวม การใช้ หรือการเปิดเผยข้อมูลส่วนบุคคล รวมถึงการประมวลผลที่ผู้ใช้งานได้ให้ความยินยอมโดยชอบด้วยกฎหมายไว้แล้วก่อนวันที่การถอนความยินยอมมีผลบังคับ
การจัดเก็บและการโอนข้อมูลส่วนบุคคล
ข้อมูลส่วนบุคคลที่เก็บรวบรวมผ่านบริการจะถูกจัดเก็บและประมวลผลภายในเขตสหภาพยุโรป/เขตเศรษฐกิจยุโรป (EU/EEA) หรือในประเทศที่คณะกรรมาธิการยุโรปพิจารณาแล้วว่ามีระดับการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ หรือประมวลผลโดยผู้ให้บริการที่ได้เข้าทำข้อตกลงที่มีผลผูกพันซึ่งสอดคล้องกับข้อกำหนดทางกฎหมายเกี่ยวกับการโอนข้อมูลไปยังต่างประเทศ หรือโดยผู้ให้บริการรายอื่นที่มีมาตรการคุ้มครองที่เพียงพอเพื่อคุ้มครองสิทธิของเจ้าของข้อมูลส่วนบุคคลที่ถูกโอนข้อมูล
หากประสงค์จะขอเอกสารเกี่ยวกับมาตรการคุ้มครองดังกล่าว สามารถติดต่อบริษัทได้ตามรายละเอียดการติดต่อในข้อ 9
ข้อมูลส่วนบุคคลที่เก็บรวบรวมผ่านบริการนี้เป็นข้อมูลที่เก็บรวบรวมจากเจ้าของข้อมูลภายในราชอาณาจักรไทย บริษัทจะโอนข้อมูลส่วนบุคคลของท่านออกนอกประเทศไทยเฉพาะในกรณีที่เป็นไปตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (“PDPA”) รวมถึงแต่ไม่จำกัดเฉพาะกรณีดังต่อไปนี้
• การโอนไปยังประเทศหรือดินแดนที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (PDPC) พิจารณาแล้วว่ามีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ
• การประมวลผลโดยผู้ให้บริการที่ได้ทำข้อตกลงที่มีผลผูกพันซึ่งสอดคล้องกับข้อกำหนดทางกฎหมายเกี่ยวกับการโอนข้อมูลส่วนบุคคลข้ามพรมแดน
• การประมวลผลโดยผู้ให้บริการรายอื่นที่มีมาตรการคุ้มครองที่เหมาะสมเพื่อคุ้มครองสิทธิของเจ้าของข้อมูลส่วนบุคคล
• ในกรณีที่มีความจำเป็นและไม่อาจหลีกเลี่ยงได้ บริษัทอาจโอนข้อมูลส่วนบุคคลไปยังประเทศที่ไม่มีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอ อย่างไรก็ตาม บริษัทจะใช้ความพยายามอย่างดีที่สุดเพื่อให้มั่นใจว่าข้อมูลส่วนบุคคลของท่านได้รับการคุ้มครองตามมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลของประเทศไทย
ระยะเวลาในการประมวลผลข้อมูลส่วนบุคคล
ข้อมูลส่วนบุคคลจะถูกจัดเก็บและประมวลผลเป็นระยะเวลา 1 ปี เว้นแต่กฎหมายจะกำหนดไว้เป็นอย่างอื่น หรือบริษัทเห็นว่ามีความจำเป็นสำหรับวัตถุประสงค์ที่ระบุไว้ข้างต้น
โปรดทราบว่า ผู้สมัครงาน (ผู้ใช้งาน) อาจเป็นผู้ที่บริษัทสนใจสำหรับการสรรหาในอนาคต และเพื่อวัตถุประสงค์ดังกล่าว บริษัทอาจเก็บรักษาข้อมูลส่วนบุคคลของผู้ใช้งานไว้จนกว่าข้อมูลดังกล่าวจะไม่มีความเกี่ยวข้องหรือไม่มีประโยชน์ต่อการพิจารณาสรรหาในอนาคตอีกต่อไป
หากท่านในฐานะผู้ใช้งานไม่ประสงค์ให้บริษัทประมวลผลข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ดังกล่าว (การสรรหาในอนาคต) โปรดติดต่อบริษัทตามรายละเอียดการติดต่อในข้อ 9
3. สิทธิของผู้ใช้งาน
ผู้ใช้งานมีสิทธิขอรับข้อมูลเกี่ยวกับข้อมูลส่วนบุคคลที่บริษัทประมวลผลอยู่ โดยแจ้งเป็นลายลักษณ์อักษรมายังบริษัทตามรายละเอียดการติดต่อในข้อ 9
ผู้ใช้งานมีสิทธิได้รับสำเนาข้อมูลส่วนบุคคลของตนที่อยู่ในกระบวนการประมวลผลจำนวนหนึ่ง (1) ชุด โดยไม่มีค่าใช้จ่าย สำหรับสำเนาเพิ่มเติม บริษัทมีสิทธิเรียกเก็บค่าธรรมเนียมตามสมควรตามต้นทุนการบริหาร
ทั้งนี้ รวมถึงสิทธิในการขอเปิดเผยที่มาของข้อมูลส่วนบุคคลที่บริษัทได้รับมาในกรณีที่ผู้ใช้งานไม่ได้ให้ความยินยอมไว้
ผู้ใช้งานมีสิทธิได้รับข้อมูลส่วนบุคคลของตนจากผู้ควบคุมข้อมูลส่วนบุคคล ในกรณีที่ผู้ควบคุมข้อมูลส่วนบุคคลได้จัดทำข้อมูลดังกล่าวให้อยู่ในรูปแบบที่สามารถอ่านหรือใช้งานได้โดยทั่วไปด้วยเครื่องมือหรืออุปกรณ์อัตโนมัติ และสามารถใช้หรือเปิดเผยโดยวิธีการอัตโนมัติได้
นอกจากนี้ ผู้ใช้งานยังมีสิทธิดังต่อไปนี้
(1)ขอให้ผู้ควบคุมข้อมูลส่วนบุคคลส่งหรือโอนข้อมูลส่วนบุคคลในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น เมื่อสามารถดำเนินการได้ด้วยวิธีการอัตโนมัติ
(2) ขอรับข้อมูลส่วนบุคคลที่ผู้ควบคุมข้อมูลส่วนบุคคลส่งหรือโอนในรูปแบบดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่นโดยตรง เว้นแต่ไม่สามารถดำเนินการได้ด้วยสภาพทางเทคนิค
ผู้ใช้งานมีสิทธิขอแก้ไขข้อมูลส่วนบุคคลที่ไม่ถูกต้องเกี่ยวกับตนเอง เพื่อให้ข้อมูลดังกล่าวมีความถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิด โดยยื่นคำขอเป็นลายลักษณ์อักษรตามรายละเอียดการติดต่อในข้อ 9
ผู้ใช้งานมีสิทธิขอให้ผู้ควบคุมข้อมูลส่วนบุคคลลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลไม่สามารถระบุตัวบุคคลได้ ทั้งนี้ ภายใต้เงื่อนไขที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทยกำหนด
ผู้ใช้งานมีสิทธิขอให้ผู้ควบคุมข้อมูลส่วนบุคคลจำกัดการใช้ข้อมูลส่วนบุคคลของตน ภายใต้เงื่อนไขที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทยกำหนด
ผู้ใช้งานมีสิทธิคัดค้านการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคลของตนได้ตลอดเวลา ภายใต้เงื่อนไขที่กฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทยกำหนด
ผู้ใช้งานมีสิทธิถอนความยินยอมได้ตลอดเวลา โดยติดต่อผู้ควบคุมข้อมูลส่วนบุคคลตามรายละเอียดการติดต่อที่ระบุไว้ในข้อ 9 เว้นแต่จะมีข้อจำกัดเกี่ยวกับสิทธิในการถอนความยินยอมตามกฎหมาย หรือสัญญาที่ก่อให้เกิดประโยชน์แก่เจ้าของข้อมูลส่วนบุคคล
อย่างไรก็ตาม การใช้สิทธิดังกล่าวอาจส่งผลให้ผู้ใช้งานไม่สามารถสมัครงานในตำแหน่งที่ต้องการ หรือไม่สามารถใช้บริการดังกล่าวได้
การถอนความยินยอมจะไม่ส่งผลกระทบต่อการเก็บรวบรวม การใช้ หรือการเปิดเผยข้อมูลส่วนบุคคล รวมถึงการประมวลผลข้อมูลส่วนบุคคลที่ผู้ใช้งานได้ให้ความยินยอมโดยชอบด้วยกฎหมายไว้แล้วก่อนวันที่การถอนความยินยอมมีผลบังคับ
ผู้ใช้งานมีสิทธิในการโอนย้ายข้อมูลส่วนบุคคลภายใต้เงื่อนไขบางประการ ซึ่งหมายถึงสิทธิในการขอรับข้อมูลส่วนบุคคลของตนและโอนข้อมูลดังกล่าวไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่น ตราบเท่าที่การดำเนินการดังกล่าวไม่กระทบต่อสิทธิและเสรีภาพของบุคคลอื่น
ผู้ใช้งานมีสิทธิร้องเรียนในกรณีที่ผู้ควบคุมข้อมูลส่วนบุคคล หรือผู้ประมวลผลข้อมูลส่วนบุคคล รวมถึงพนักงานหรือผู้รับจ้างของบุคคลดังกล่าว ฝ่าฝืนหรือไม่ปฏิบัติตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทย หรือประกาศที่ออกตามกฎหมายดังกล่าว
4. ความมั่นคงปลอดภัยของข้อมูล
บริษัทให้ความสำคัญกับความเป็นส่วนตัวของบุคคลเป็นอย่างยิ่ง และดำเนินการอย่างต่อเนื่องเพื่อให้มั่นใจว่าข้อมูลส่วนบุคคลของผู้ใช้งานได้รับการประมวลผลด้วยความระมัดระวังสูงสุด
บริษัทดำเนินมาตรการที่สมเหตุสมผลตามที่พึงคาดหมายได้ เพื่อให้มั่นใจว่าข้อมูลส่วนบุคคลของผู้ใช้งานและบุคคลอื่นได้รับการประมวลผลอย่างปลอดภัย และเป็นไปตามประกาศความเป็นส่วนตัวฉบับนี้ กฎหมาย GDPR หรือกฎระเบียบที่ออกภายใต้ GDPR และ/หรือกฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทย รวมถึงประกาศที่ออกตามกฎหมายดังกล่าว
อย่างไรก็ตาม การส่งข้อมูลผ่านเครือข่ายอินเทอร์เน็ตและเครือข่ายโทรศัพท์เคลื่อนที่ไม่สามารถปราศจากความเสี่ยงได้โดยสิ้นเชิง ดังนั้น ผู้ใช้งานจึงควรมีส่วนร่วมในการดูแลรักษาความปลอดภัยของข้อมูลของตนเอง
ผู้ใช้งานมีหน้าที่รับผิดชอบในการเก็บรักษาข้อมูลสำหรับการเข้าสู่ระบบ (Login Information) ไว้เป็นความลับ
5. การเปิดเผยหรือโอนข้อมูลส่วนบุคคลให้แก่บุคคลภายนอก
บริษัทจะไม่จำหน่าย เปิดเผย หรือโอนข้อมูลส่วนบุคคลของผู้ใช้งานให้แก่บุคคลภายนอก อย่างไรก็ตาม บริษัทอาจเปิดเผยหรือโอนข้อมูลส่วนบุคคลให้แก่
• ผู้รับจ้างหรือผู้รับจ้างช่วงของบริษัท ซึ่งปฏิบัติหน้าที่ในฐานะผู้ประมวลผลข้อมูลส่วนบุคคล (Processor) หรือผู้ประมวลผลข้อมูลส่วนบุคคลช่วง (Sub-Processor) ตามคำสั่งของบริษัท เพื่อให้บริการที่เกี่ยวข้อง

Privacy Notice for recruitment using Teamtailor
The service for handling recruitments and simplifying the hiring process (the "Service") is powered by Teamtailor on behalf of BYD AUTO (THAILAND) COMPANY LIMITED and BYD AUTO COMPONENTS (THAILAND) COMPANY LIMITED (“Controller”, “we”, “us”, etc.). It is important that the persons using the Service ("Users”) feel safe with, and are informed about, how we handle Users' personal data in the recruitment process. We strive to maintain the standards of Thai law regarding the protection of personal data. We process, manage, use, and protect User's Personal Data in accordance with this Privacy Notice ("Privacy Notice").
1. General
We are the controller in accordance with current privacy legislation of Thailand. The Users’ personal data is processed with the purpose of managing and facilitating the recruitment of employees to our business.
It is necessary for us to use the Users' personal data for the purpose of entering into an employment contract. If the Users do not provide such personal data, it may result in our inability to enter into an employment contract with the Users.
2. Collection of personal data
We are responsible for the processing of the personal data that the Users contribute to the Service, or for the personal data that we collects in other ways with regards to the Service.
When and how we collect personal data
We collect personal data about Users from Users when Users;
- make an application through the Service or otherwise, adding personal data about themselves either personally or by using a third-party source such as Facebook or LinkedIn; and
- use the Service to connect with our staff, adding personal data about themselves either personally or by using a third-party source such as Facebook or LinkedIn; and
- provide identifiable data in the chat (provided through the website that uses the Service) and such data is of relevance to the application procedure.

In some cases, existing employees can make recommendations about potential applicants. Such employees will add personal data about those potential applicants. In the cases where this is performed, the potential applicant is considered a User in the context of this Privacy Notice and will be informed about the processing.

In cases where we need to process sensitive personal data, such as health information or criminal records, we will obtain explicit consent from the Users and will act under the control of the competent authorities in accordance with the laws of Thailand.
Purpose and lawfulness of processing
The purpose of collecting and processing of personal data is to manage recruiting. The lawfulness of the processing of personal data is based on the consent we have obtained from the Users. In case where consent is not obtained, we may use other bases permitted by law to process the Users personal data without the Users’ consent, such as for our legitimate interest or for the necessity to take steps at the request of the Users prior to entering into an employment contract, in order to facilitate the processing of personal data.
The consent of the data subject
The Users consent to the Controler processing their personal data for the purpose of Controller’s handling recruiting. The Users consent that personal data is collected through the Service, when the Users;
a) make an application through the Service, adding personal data about themselves either personally or by using a third-party source such as Facebook or LinkedIn, and that Controller may use external sourcing tools to add additional information;
b) when they use the Service to connect to Controller’s recruitment department, adding personal data about themselves either personally or by using a third-party source such as Facebook or LinkedIn; and
c) In cases where we need to process sensitive personal data, such as health information or criminal records, we will obtain explicit consent from the Users and will act under the control of the competent authorities in accordance with the laws of Thailand.
The Users consent to the Controller disclosing their personal data to third parties and/or transferring their personal data across borders to foreign countries for the purpose of the Controller’s management of recruitment.
The Users consent to the Controller’s collecting of publicly available information about the Users and compiling it for recruitment purposes.
The Users have the right to withdraw their consent at any time, by contacting the Controller using the contact details listed under Section 9, unless there are restrictions on the right to withdraw consent by law or by a contract that benefits the data subject. However, using this right may mean that the Users cannot apply for a specific job or otherwise use the Service. The withdrawal of consent shall not affect the collection, use, or disclosure of personal data and our processing for which the Users have already legally given consent prior to the withdrawal taking effect.
Storage and transfers
The personal data collected through the Service is stored and processed within the EU/EEA, or such third country that is considered by the European Commission to have an adequate level of protection, or processed by such suppliers that have entered into such binding agreements that fully comply with the lawfulness of third country transfers or to other suppliers where adequate safeguards are in place to protect the rights of the data subjects whose data is transferred. To obtain documentation regarding such adequate safeguards, contact us using the Contact details listed in Section 9.
The personal data collected through this Service shall be collected from data subjects within the Kingdom of Thailand. We will transfer your personal data outside of Thailand only under circumstances compliant with the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”), including but not limited to the following cases:
-Transferring to countries or territories deemed by the Personal Data Protection Committee (PDPC) to have an adequate level of personal data protection;
-Processing by suppliers with whom binding agreements have been concluded, fully complying with legal requirements for cross-border data transfers to third countries; and
-Processing by other suppliers that have established adequate safeguards to protect the rights of data subjects.
-If necessary and unavoidable, we may transfer data across borders to destinations that do not have an adequate level of personal data protection, but we will use our best efforts to ensure that your personal data receives protection in accordance with the personal data protection standards of Thailand.
How long the personal data will be processed
The personal data will be stored and processed for a period of 1 years, unless otherwise authorized by law or deem necessary by us for the purposes stated above. Please note that an applicant (User) may be of interest for future recruitment and for this purpose, we may store the User’s Personal Data until it is no longer relevant for potential recruitment. If you, as a User, do not wish to have your Personal Data processed for this purpose (future recruitment) please contact us using the contact details in Section 9.
3. Users’ rights
The Users have the right to request information about the personal data that is processed by us, by notifying us in writing, using the contact details provided in Section 9 below. Users have the right to one (1) copy of the processed personal data which belongs to them without any charge. For further demanded copies, the Controller has the right to charge a reasonable fee on the basis of the administrative costs for such demand. This includes the right to request disclosure regarding the acquisition of such personal data for which the Users have not given consent.
The Users have the right to obtain personal data concerning themselves from the Controller in the event that the Controller has made such personal data available in a format that is readable or commonly usable by way of automatic tools or equipment, and can be used or disclosed by automated means. The Users also have the following rights:
(1) To request the Controller to send or transfer the personal data in such format to other data controllers when it can be done by automated means: and
(2) To receive the personal data that the Controller sends or transfers in such format directly to other data controllers, except where it is technically unfeasible.
The Users have the right to request the rectification of inaccurate personal data concerning themselves to ensure that such data is accurate, up-to-date, complete, and not misleading, via a written request, using the contact details provided in Section 9 below.
The Users have the right to request the Controller to delete, destroy, or render the personal data non-identifiable, subject to the conditions specified under the personal data protection laws of Thailand.
The Users have the right to request the Controller to restrict the use of their personal data, subject to the conditions specified under the personal data protection laws of Thailand.
The Users have the right to object to the collection, use, or disclosure of personal data concerning themselves at any time, subject to the conditions specified under the personal data protection laws of Thailand.
The Users have the right to withdraw their consent at any time, by contacting the Controller using the contact details listed under Section 9, unless there are restrictions on the right to withdraw consent by law or by a contract that benefits the data subject.. However, using this right may mean that the Users cannot apply for a specific job or otherwise use the Service. The Users have under certain circumstances a right to data portability, which means a right to get the personal data and transfer these to another controller as long as this does not negatively affect the rights and freedoms of others.
The Users have the right to lodge a complaint in the event that the Controller or the Data Processor, including their employees or contractors, violates or fails to comply with the personal data protection laws of Thailand or the announcements issued under the personal data protection laws of Thailand.
4. Security
We prioritize the personal integrity and therefore works actively so that the personal data of the Users are processed with utmost care. We take the measures that can be reasonably expected to the make sure that the personal data of Users and others are processed safely and in accordance to this Privacy Notice, the GDPR or the regulations issued under GDPR, and/or the personal data protection laws of Thailand or the announcements issued under the personal data protection laws of Thailand.
However, the transfer of information over the internet and mobile networks can never occur without any risk, It is important that Users also take responsibility to ensure that their data is protected. It is the responsibility of the Users to ensure that their login information is kept secret.
5. Disclose/Transfer of personal data to third party
We will not sell, disclose, or otherwise transfer Users’ personal data to third parties. However, we may disclose or transfer Users’ Personal Data to;
- Our contractors and sub-contractors, acting as our Processors and Sub-Processors in accordance with our instructions, for the provision of the Service;
- Authorities or legal advisors in case criminal or improper behaviour is suspected; and
- Authorities, legal advisors or other actors, if required by us according to law or authority’s injunction.
- Our parent company, group companies, affiliates, business partners, and associates.
We will only transfer Users’ personal data to third parties that we have confidence in. We carefully choose partners to ensure that the User’s personal data is processed in accordance with current privacy legislation. We cooperate with the following categories of processors of personal data: Teamtailor, who supplies the Service, server and hosting companies, e-mail reference companies, video processing companies, information-sourcing companies, analytical service companies and other companies with regard to supplying the Service.
6. Aggregated data (non-identifiable personal data)
We may share aggregated data to third parties. The aggregated data has in such instances been compiled from information that has been collected through the Service and can, for example, consist of statistics of internet traffic or the geological location for the use of the Service. The aggregated data does not contain any information that can be used to identify individual persons and is thus not personal data.
7. Cookies
When Users use the Service, information about the usage may be stored as cookies. Cookies are passive text files that are stored in the internet browser on the User’s device, such as computer, mobile phone or tablet, when using the Service. We use cookies to improve the User’s usage of the Service and to gather information about, for example, statistics about the usage of the Service. This is done to secure, maintain and improve the Service. The information that is collected through the cookies can in some instances be personal data and is, in such instances, regulated by our Cookie Policy.
Users can at any time disable the use of cookies by changing the local settings in their devices. Disabling of cookies can affect the experience of the Service, for example disabling some functions in the Service.
8. Changes
We reserve the right to make changes or additions to the Privacy Notice at any time. The latest version of the Privacy Notice will always be available through the Service. A new version is considered communicated to the Users when the Users have either received an email informing the Users of the new version (using the e-mail stated by the User in connection to the use of the Service) or when the Users are otherwise informed of the new Privacy Notice.
